Please read this agreement carefully before signing. By signing below, I acknowledge that I have read, understand, and agree to the following terms.
READ CAREFULLY BEFORE SIGNING YOU ARE GIVING UP LEGAL RIGHTS
1. ASSUMPTION OF RISK
I understand that skiing, snowboarding, and the use of ski and snowboard rental equipment are recreational activities that involve inherent and other risks of injury, property damage, and, in some circumstances, serious injury or death.
I understand that risks may include, but are not limited to:
Falls and collisions with other participants, objects, trees, fences, buildings, vehicles, lifts, or other obstacles.
Changes in terrain, snow conditions, weather, visibility, or surface conditions.
Steep slopes, moguls, jumps, ice, rocks, trees, and other natural or man-made hazards.
Equipment failure, malfunction, improper adjustment, or unexpected release of bindings.
Injuries resulting from the use, transportation, handling, or storage of rental equipment.
The actions or negligence of other skiers, snowboarders, guests, employees, contractors, or third parties.
Risks associated with riding at ski resorts, on trails, or in other areas where skiing or snowboarding occurs.
I voluntarily assume all risks associated with participating in skiing, snowboarding, and using rental equipment, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by law.
2. RELEASE AND WAIVER OF LIABILITY
In consideration for being permitted to rent and use equipment from The Ski Ladies LLC, I voluntarily release, waive, discharge, and agree not to sue The Ski Ladies LLC, its owners, members, employees, agents, representatives, contractors, and any other parties acting on its behalf for claims arising from my use of the rental equipment or participation in skiing or snowboarding activities, to the fullest extent permitted by applicable law.
This release includes claims for personal injury, death, property damage, loss, or other damages arising from the use of the rental equipment or participation in skiing or snowboarding, except to the extent such a release is prohibited by law.
3. EQUIPMENT CONDITION AND USE
I acknowledge that I have had the opportunity to inspect the equipment provided to me and agree that it is in acceptable condition for its intended use, subject to normal wear and tear.
I agree to:
Use the equipment only for its intended purpose.
Follow all applicable laws, resort rules, posted warnings, and safety instructions.
Not modify, alter, or tamper with the equipment.
Not allow unauthorized individuals to use my rental equipment.
Take reasonable care of all rented equipment.
Immediately notify The Ski Ladies LLC of any equipment problem, damage, or malfunction.
Return all equipment in accordance with the rental agreement.
I understand that rental equipment is not a substitute for proper instruction, experience, or safe decision-making.
4. BINDINGS AND EQUIPMENT SETTINGS
I understand that ski and snowboard bindings and other rental equipment are designed to function within certain limitations. I understand that bindings may not release in every situation that could result in injury and may release unexpectedly under certain circumstances.
I understand that no binding system can prevent all injuries.
I acknowledge that The Ski Ladies LLC does not guarantee that the rental equipment will prevent injury.
5. PERSONAL RESPONSIBILITY
I understand that I am responsible for determining whether I am physically and technically capable of safely participating in skiing or snowboarding and using the rental equipment.
I agree not to use the equipment if I am under the influence of alcohol, drugs, medication, or any other substance that may impair my ability to safely participate.
I agree to stop using the equipment if I believe that continuing to do so would be unsafe.
6. MINORS
If the person using the rental equipment is under 18 years of age, the parent or legal guardian signing this agreement represents that they have the legal authority to sign on behalf of the minor.
The parent or legal guardian acknowledges the risks described in this agreement and agrees to the terms of this waiver on behalf of the minor, to the fullest extent permitted by law.
7. EQUIPMENT LOSS, DAMAGE, OR THEFT
I understand that I am responsible for the rental equipment while it is in my possession.
I agree to promptly notify The Ski Ladies LLC if equipment is lost, stolen, damaged, or otherwise becomes unusable.
I understand that optional rental insurance, if offered and purchased, is subject to its separate terms, conditions, exclusions, and limitations. Purchasing rental insurance does not eliminate my responsibility for damage, loss, theft, misuse, negligence, or other circumstances excluded from coverage.
8. MEDICAL TREATMENT
In the event of an emergency, I authorize reasonable emergency medical assistance to be sought on my behalf when necessary. I understand that I am responsible for any medical expenses incurred as a result of an injury or emergency.
9. ACKNOWLEDGMENT OF RESPONSIBILITY
I understand that safe skiing and snowboarding require personal responsibility and good judgment. I agree to follow applicable safety rules and to use the equipment responsibly.
I acknowledge that I have had the opportunity to ask questions regarding this agreement and the rental equipment before signing.
10. ACKNOWLEDGMENT AND AGREEMENT
By signing below, I acknowledge that:
I have read this entire agreement.
I understand the risks associated with skiing, snowboarding, and using rental equipment.
I understand that skiing and snowboarding can result in serious injury or death.
I voluntarily assume these risks.
I agree to the terms of this Liability Waiver and Release.
I understand that this agreement is intended to be legally binding to the fullest extent permitted by law.
I understand that I am responsible for providing accurate information and for complying with the rental agreement and all applicable rules.
